    Requirements for E1 and E2 Visas

    Eligibility
    For the E-1 Treaty Trader Visa

    Nationals belonging to a foreign country that has signed a trade and investment treaty with the U.S. are eligible for the E-1 visa only if they fulfill the following requirements:

    Even prior to the filing of the E-1 visa application, the applying nationals must have engaged in substantial trade between the treaty country and the U.S.

    At least 50% of the total amount of trade conducted by the individual or the organization must be between the U.S. and the treaty nation.

    For the E-2 Treaty Trader Visa

    The eligibility conditions for E-2 visa are same as for the E-1 visa except that applicants must solely

    Be an employee who has to perform services that require special qualifications and that are indispensable to the operations of the treaty investor’s enterprise.

    Document Requirements
    For the E-1 Visa

    Foreign nationals are required to submit the following documents for processing

    A copy of the passport and a statement explaining the structure and function of the business.

    Documents, such as trade invoices, sales reports, company financial statements and so on that show that there has been continued trade between the U.S. and the treaty country.

    To support all secondary applications, applicants must provide a copy of the birth certificate and marriage certificate.

    For applicants already residing in the U.S, a copy of U.S. Visa and Form I-94 is considered mandatory.

    For the E-2 Visa

    A few more additional documents are required for processing the E-2 visa in addition to those required for the E-1 visa

    A business plan explaining the nature and function of the business from start to finish, the initial investment, and employment projections.

    A comprehensive letter must be sent to the US Immigration Services revealing the level of the applicant’s role in the investment.

    An employee should submit his proof of position, such as organizational chart, job description, and recruitment efforts.

    The 2012 Diversity Visa Green Card Lottery

    Every year, the U.S. Department of State conducts a congressionally-mandated lottery called the Diversity Visa Lottery program that grants around 50,000 U.S. permanent resident visas to foreign nationals who meet certain eligibility standards specified by the U.S. law. Such diversity visas are available only to nationals of countries with relatively low U.S. immigration rates. Under this visa lottery program, successful participants are granted permanent residence and work status.

    Diversity Visa Lottery Process and Distribution

    The visas are distributed on a regional basis. The maximum number of visas under the visa lottery program will go to regions with lower rates of immigration to the U.S.

    No visas will go to citizens of countries sending more than 50,000 immigrants to the U.S. in the past 5 years.
